Confiscation of Dh981,962 by Ellis Ford & Co gets approval

DUBAI — The Dubai Court of Cassation has upheld the verdict of lower courts in dismissing the appeal filed by Rashid Khalaf seeking stay on the confiscation of his assets in two banks amounting to £147,000 (Dh981,962) by Ellis Ford and Company.

According to the case history, Ellis Ford had approached Judge of Urgent Matters and requested for orders to confiscate Rashid’s bank assets following a verdict to that effect given by the Higher Court of London. The judge, however, rejected the request for the order.

The company subsequently filed an appeal before the Court of First Instance, which accepted its request. Rashid contested the verdict in the Court of Appeal and argued that the company did not file the writ seeking confiscation of his assets within the stipulated time as prescribed by law.

He also argued that the company had not stated the reasons for the confiscation. The Appeals Court, however, upheld the lower court’s judgment.

As a last resort, Rashid approached the Court of Cassation, which too decided in favour of Ellis Ford, and dismissed the former’s appeal.
