Pakistan Supreme Court orders report on vote verification
A three-members bench of the top court presided over by Chief Justice Tassaduq Hussain Jillani took up the case for hearing on Monday.
The court has directed secretary election commission to submit a report in respect of four constituencies within 15 days besides directing the election tribunal of Lahore and Multan to present their reports within 15 days in respect of NA-125 Lahore and NA-154 Lodhran.
The court said, “it cannot offer any comment if any rigging was carried out or otherwise in the general elections. The court’s powers are restricted under section 184(3) and article 225 of the constitution which prevent the court from hearing such petitions. However, we are issuing these orders in the light of court rulings. The election commission of Pakistan (ECP) should explain as to why tribunals constituted by it have not heard petitions filed with them on these matters.”
Imran said that came to the court not to get the results of general elections changed, but he wants steps should be taken to prevent poll rigging of this sort in future.
A three-members bench of the top court presided over by Chief Justice Tassaduq Hussain Jillani took up the case for hearing on Monday on verification of thumb impressions.
The CJ inquired Imran if a review petition has been filed or he is a separate party to this case.
Hamid Khan said this is not a review petition but it is a separate petition.
Hamid Khan said general elections were held on May, 11, 2013 and the PTI also took part therein. Records of rigging were set in the polls and the PTI remained victim mostly to this rigging and its mandate was stolen. The court had ordered for holding elections in transparent manner but it could not occur so.
The court inquired if “you had given any preliminary application on conclusion of the elections. If such type of applications are available there.”
The court was told cases were registered on individual basis. Some applications were dismissed which were filed under 103AA and some are still pending. Verification was got done from National Database and Registration Authority (Nadra) on the application of PTI Sindh and thousands of fake votes were found. Chaudhry Nisar Ali Khan had given statement in parliament if thumb impressions were got checked then votes ranging between 60,000 and 70,000 would be found fake in every constituency. He said 60,000 out of 83,000 votes were found bogus during verification of thumb impression process in one constituency of NA-256 Karachi.
Hamid told the court, “we want your limited order to stop wrong things from occurring in future.” The court adjourned the hearing of the case for indefinite period.
