Divorce plea rejected, but alimony raised

Omaya Abdulazeez filed a lawsuit before the Abu Dhabi Court of First Instance, demanding a monthly alimony, divorce and all her rights from the abusive husband Husam Alyan. She claimed that after the marriage, her husband refused to support her financially, beat her up and kicked her out of his house, all because she did not accept his misbehaviour, including having sex outside marriage. However, the husband filed a counter suit demanding that his wife be forced to return home and be obedient to him.

Meanwhile, the Court of First Instance issued its verdict forcing the husband to pay Dh1,500 monthly alimony to the wife, while rejecting the plea for divorce filed by the plaintiff, besides ordering her to return to her husband’s house in Musafah. Both parties appealed against the verdict, and the Court of Appeal amended the verdict by granting the wife Dh2,000 monthly alimony, while upholding the verdict rejecting divorce. The husband filed another appeal before the Supreme Court, which rejected his plea and upheld the previous verdict.
