Five-year prison sentence of rapist upheld

The Court of Appeal upheld the five-year prison term given by a lower court to a bus driver, who sexually assaulted a young woman with special needs when he was taking her home in Al Warqa at a late hour.

The court also upheld the deportation order against the 26-year-old Pakistani man.

The victim, an Emirati, is severely mentally impaired and does not reason like adults as per a medical report from Rashid Hospital. The incident was reported by a Filipina woman, 39, who said in the prosecution investigation that she worked as the supervisor of the bus for a sports club.

She said that she witnessed the incident which took place in July last year. On that day, she was in the bus dropping the special needs club female members.

The accused asked the victim whether he should pull over before dropping her home in Al Warqa and she agreed, the supervisor testified. The supervisor said that both of them moved to the back seats of the bus and stayed there for about 10 minutes.

The victim came near her shortly later with her clothes and abaya in a mess while the defendant had his pants down.

When the accused dropped the victim home, he looked tense and asked the supervisor not to inform anyone about the incident.

However, she reported the incident later to the administration.

The supervisor also said that she saw the defendant having sex with the victim.

The defendant admitted in the investigation that he sexually assaulted the victim being aware that she was mentally retarded with a child’s reasoning capability.

The Public Prosecution enclosed to the case file the medical report stating that the victim had a very low IQ which affected her social and life personal skills.

According to the report, she was not aware of the legal consequences of her acts and could be easily exploited by others.

As per the Criminal Lab report, traces of semen lifted from the bus matched with the defendant’s.

The forensic medicine report confirmed that the victim was sexually assaulted.
